Vancouver, BC, Canada, December 10, 2020, Xebra Brands Ltd. (“Xebra”) is pleased to report that Mexico’s Supreme Court has extended the deadline for cannabis legalization to April 30, 2021. This extension provides more than a four-month window for the Supreme Court to rule on Xebra’s constitutional claim to obtain an injunction authorizing it to be the first in Mexico to legally commercialize hemp derived cannabinoids such as CBD and CBG.

The claim was filed in January 2019, and the injunction requested includes the right for the importation of seeds, cultivation anywhere in Mexico without limitation on size, harvesting, processing, the creation of cannabis products with less than 1% THC, and the right to sell those products domestically or by export.

Mexico’s Supreme Court ordered Congress to legalize cannabis by December 15, 2020. The Mexican Senate approved a bill to legalize both medicinal and recreational cannabis on November 19, 2020. The proposed bill subsequently moved to the floor of the Chamber of Deputies, where it was defeated on the basis that it was ambiguous in scope and in its objectives.

As a consequence, the Supreme Court has extended the deadline for legalization to April 30, 2021. The Supreme Court stated that its decision was considerably influenced by the health crisis resulting from COVID-19 and the need to provide Congress with ample time to finetune the proposed bill. The final bill if approved by Congress, requires the approval of the President of Mexico, whom expressed support for the previous version of the bill approved by the Senate.
